IP Australia has a number of nifty tools that can help you to check whether someone else has already trade marked the name that you'd like to use.
Important things to know about these tools:
- They can't tell you whether a trade mark is "available" to register
- These tools will work their magic and give you results but it takes some knowledge and skill to understand what those results mean for you and your business
- The lovely staff at IP Australia are not allowed to do that analysis or tell you what the results mean unless you lodge a trade mark application
The purpose of this training is to show you how to to do the search so you don't miss anything important and then to analyse the results. Feel confident that you can safely use a name BEFORE you actually start to use it.

I'll highlight the common mistakes that people make along the way and will point out the steps that you absolutely need to get right, if you want your trade mark to be enforceable once it is finally registered.

You've noticed that someone else is using a name or logo that is suspiciously similar to yours. But is it infringement of your trade mark? And if it is, what do you do?
The purpose of this training is to help you to determine whether your situation is trade mark infringement or not and to outline the options for dealing forward:
- what factors should you consider to determine whether infringement has occurred
- could the other business have a defence against infringement?
- do you need an attorney or is this something you can handle yourself?
- when and how should you contact the other business?
- what kind of outcome can you expect?
